These Terms of Service (the “Terms”) govern your access to and use of the website operated by True Eden Restoration LLC (“True Eden,” “we,” “us,” or “our”), available at trueedenrestoration.com. By using the website, contacting us through the contact form, or otherwise engaging with our services, you agree to these Terms. If you do not agree, please do not use the website.
1. Who we are and what the website does
True Eden Restoration is a home-based water, fire, mold, storm, and sewage damage restoration business operating out of Elgin, IL and serving the Chicago suburbs. The website is an informational and lead-intake resource. It describes our services, lets you reach us, and lets you submit a request for an on-site assessment.
The website itself is not a contract for restoration services. The relationship between you and us regarding any actual restoration work is governed by the separate written work authorization and scope of work you sign with us before work begins (see Section 4).
2. Permitted use of the website
- You may use the website to learn about our services, contact us, and submit a request for an on-site assessment.
- You agree not to use the website in any way that could damage, disable, overburden, or impair it, or interfere with anyone else’s use of it.
- You agree not to attempt to gain unauthorized access to the website, our systems, or any account, server, or network connected to the website.
- You agree not to submit false, misleading, or fraudulent information through the contact form, including impersonating someone else or providing a phone number you do not have permission to enter.
- You agree not to scrape, copy, or republish the website’s content for any commercial purpose without our written permission.
3. Estimates, pricing, and emergency response
Any pricing, timelines, or scope information shown on this website (including in blog content, FAQ answers, and service-page copy) is general information for educational purposes. It is not a binding estimate or quote for your specific project.
Binding estimates require an on-site or remote assessment of your property and are provided to you in writing in the format your insurance carrier accepts (typically Xactimate). A final estimate is binding only after we both sign a written work authorization.
We strive to respond to emergency calls 24/7 with a target arrival window of 1–2 hours across the Chicago suburbs, but we do not guarantee a specific arrival time on the website. Weather, traffic, the volume of active jobs, and the safety conditions at your property may affect dispatch timing. Emergency response timing is a best-effort goal, not a contractual commitment, until a written work authorization is signed.
4. Written work authorizations govern actual services
Restoration services we perform for you are governed by a written work authorization, scope of work, and (where applicable) direction-to-pay or assignment-of-benefits agreement that you sign before work begins. Those documents — not these Terms or the website content — set out the scope, price, payment terms, workmanship warranty, and any limitations that apply to the work itself. If there is any conflict between the website and your signed work authorization, the signed document controls.
5. Insurance claim coordination
When you authorize us to coordinate with your insurance carrier, we document the loss, write the scope of work in the format the carrier uses, communicate with the assigned adjuster, and negotiate supplements where the original scope is incomplete. We do this as the restoration contractor — not as a licensed public adjuster, attorney, or your insurance representative.
Your insurance policy is a contract between you and your carrier, and we have no authority to bind your carrier or guarantee coverage of any particular loss. Coverage decisions, deductibles, sublimits, and policy exclusions remain between you and your carrier. We will tell you what is typically covered and uncovered under standard policy language, but the carrier’s written determination is what governs your claim.
6. Intellectual property
The website’s content — including text, photos, illustrations, logos, the True Eden name and brand, page layouts, and code — is owned by True Eden Restoration or our licensors and is protected by U.S. and international copyright, trademark, and other intellectual-property laws. You may view and share the content for personal, non-commercial use. Any other use (republication, training or fine-tuning of machine learning models, commercial reuse, or large-scale automated scraping) requires our prior written permission.
7. Content you submit to us
When you submit information through the contact form, send us a photo of damage, or leave a review, you grant us a non-exclusive, royalty-free, worldwide license to use that content as needed to provide service to you, coordinate your insurance claim, train our team, and, where appropriate, feature anonymized examples of work we have done (before/after photos, case-study summaries, testimonials) in our marketing. We will not publish anything that identifies you by name, address, or license-plate-readable detail without your separate consent. If you ask us to take down material that identifies you, we will.
8. Disclaimers
The website and its content are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, regarding the website — including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation.
Information on the website about insurance, IICRC standards, building codes, health implications of contaminants, drying times, and similar technical topics is provided for general informational purposes. It is not a substitute for the professional judgment of a licensed contractor, public adjuster, attorney, physician, or industrial hygienist for your specific situation.
9. Limitation of liability
To the fullest extent permitted by law, in no event will True Eden Restoration LLC or its owner, employees, contractors, partners, or service providers be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of the website — including lost profits, lost data, business interruption, or loss of goodwill — even if we have been advised of the possibility of such damages. Our aggregate liability arising out of or related to your use of the website (and not your separately signed work authorization, which has its own liability provisions) will not exceed one hundred U.S. dollars (USD $100). Nothing in this section limits any liability that cannot be limited by law.
10. Indemnification
You agree to defend, indemnify, and hold harmless True Eden Restoration LLC and its owner, employees, contractors, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the website in violation of these Terms, your violation of any law or third-party rights, or any false or misleading information you submit through the contact form.
11. Third-party links and services
The website may link to third-party websites or rely on third-party services (for example, our hosting, analytics, and lead-intake automation providers, as described in our Privacy Policy). We are not responsible for the content, products, services, or practices of third-party websites. Use of those websites is at your own risk and subject to the terms of those websites.
12. Governing law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or your use of the website will be brought exclusively in the state or federal courts located in Kane County, Illinois, and you consent to the personal jurisdiction and venue of those courts.
13. Informal dispute resolution
Before filing a lawsuit, you agree to first try to resolve any dispute informally by contacting us at trueedenrestoration@gmail.com with a written description of the dispute, your contact information, and the relief you are seeking. We will attempt to resolve it within 30 days of receipt. If we are unable to, either party may then proceed to court.
14. Changes to these Terms
We may update these Terms from time to time. The “Effective” date at the top of this page reflects the most recent revision. Continued use of the website after a change takes effect means you accept the updated Terms.
15. Severability and entire agreement
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, make up the entire agreement between you and True Eden Restoration regarding the website. Your signed work authorization for actual restoration services is a separate agreement and is not modified by these Terms.
